Last April, James Jones lost his wife of 44 years, Frances, after several months of illness. But when it came time to pay for his wife's burial, the insurance company refused to pay."Some medicine they gave her must have had a bad effect on her because she started internal bleeding and she died two weeks later," he said.James had taken out a $6,200 burial policy on Frances 14 months before she died. He felt secure knowing that her funeral expenses would be paid."She was buried on Wednesday and the next week on Monday or Tuesday, the funeral home called and said (it) was paid for," said Jones.Then one month later, Fortis Insurance, the company who sold Jones the burial policy, sent him a letter contesting the claim and denying a payout. It said Frances had a pre-existing medical condition that she failed to disclose.Jones said her doctors found no evidence of that."After losing your wife and what I went through, it was just another devastating blow to me, just one thing after another," said Jones.What happen to Jones can happen to anyone who buys life insurance. Typically, all policies have what called an incontestable clause. That means for the first two years of the policy, the company reserves the right to deny the claim.Action 9 got in touch with Fortis Insurance and began asking questions. It then changed its position and paid the burial policy.Jones said it's a burden off his shoulders."Good Lord, yeah. I mean, $6,288 might not be a lot to other people, but to me it was," he said.
