CHARLOTTE, N.C. -- Detectives are being very tight-lipped about the investigation into the fatal shooting of a seventh-grader in west Charlotte.Justin Shay, 12, died from a single gunshot wound on Saturday afternoon. Police reports reveal a family member fired the gun. Charlotte-Mecklenburg Police Department officials at first said it was an accidental shooting, but now are only referring to the case as a death investigation. Investigators say they'll gather all the evidence and present the entire case to the district attorney’s office. This is only the fourth homicide case this year that the police department has deferred to the district attorney’s office for a decision on charges. The D.A.'s office likely won't make a decision about criminal charges for several weeks because the case won't make it to their office until the end of the month. On Avalon Avenue, the street where the shooting occurred, neighbors aren't saying much. One family member said it's been a really emotionally draining 48 hours for the family. At this point, it's unclear whether Shay is from Charlotte. Charlotte-Mecklenburg Schools officials say they have no students by that named enrolled.
