CHARLOTTE, N.C. -- Eyewitness News has discovered hundreds more documents concerning Gov. Bev Perdue’s latest plan for I-485.She went public with her plan on Nov. 9. While it’s not clear whether she knew about the legal concerns before she made her announcement, it appears she did have concerns of her own after the news conference.In an e-mail dated Nov. 18, someone in the attorney general’s office wrote that the governor asked him to double-check to see if the plan was legal. Eyewitness News reporter Jason Stoogenke also uncovered a handwritten note from the same day updating the legal situation. The note indicated the treasurer’s office didn’t think the plan was legal, and that the Department of Transportation and the Attorney General’s office disagreed.When Secretary of Transportation Gene Conti was asked if Perdue should have done more legal research before pitching her idea, he said, “I don’t want to speak for the governor. I don’t know what she knew or didn’t know, but we felt all the concerns had been addressed.”Conti believes the governor’s plan will work out. State Speaker of the House Joe Hackney concurred, saying the state would probably alter the law to eliminate any chance of legal problems.
