The former Domino’s employee who appeared in a YouTube video that showed him sticking food up his nose and sneezing on it while at work entered an Alford plea to adulterating food Tuesday.

A judge convicted 32-year-old Michael Setzer of the charge, which is a felony, and sentenced him to 24 months of supervised probation. When a defendant enters an Alford plea, he admits that the evidence is strong enough for a conviction, but doesn’t admit to committing a crime.

The video showing Setzer tampering with pizza while working at a Conover Domino’s last April garnered disgust across the country. That Domino’s has since gone out of business.

Prosecutors said Setzer told police that the food was later served to customers, but Setzer’s attorney said that didn’t happen.

His attorney, Shawn Clark, added the incident was a harmless prank that turned out very badly.

“He admits it was a childish, immature, stupid, stupid thing to do,” Clark said. “He says while the food was never sent out, it was probably a bad idea to make a video of it.”

The judge also ordered Setzer to pay $1,000 in court costs and told him to stay away from Domino’s.

Police said 31-year-old Kristy Hammonds was behind the camera when the video was recorded. The case against her is still pending.
