CHARLOTTE, N.C. —

Javier Upegui switched cellphone providers after six years as a Sprint Nextel customer.

The company claimed he wasn't free to leave his contract and charged him a $350 cancellation fee.

Upegui said Sprint is mistaken.

"Because my contract expired two years after I sign with Sprint," he said.

Sprint sent a letter threatening to turn him over to collections if he didn't pay up. He complained, but it did no good.

"Nobody cares. They just say you have to pay," Upegui said.

Upegui paid the $350 fee so it wouldn't hurt his credit, then came to Action 9.

Action 9 got in touch with Sprint. The company did not comment but sent Upegui a $350 refund.

He says he could save it for a car down payment but instead has a better use for the money.

"I will not buy a car with that money. I will spend (it) with my family," he said.

Upegui now tells others to find out whether your contract is up before jumping to another provider.
