Charlotte diocese requests motion to drop sex abuse lawsuit

CHARLOTTE, N.C. — The sex abuse lawsuit against a former youth leader and the Charlotte Catholic Diocese took center stage in court Thursday.

Anchor Allison Latos first broke the news of the civil lawsuit in February.

Attorneys for the Salisbury family, which filed the lawsuit, the former youth leader and seminarian, John Brian Kaup, and the diocese argued for nearly two hours over several issues.

One of the biggest motions was the diocese's request to dismiss the case.

One reason the defense attorney argued was that the family claims Kaup raped the teen after he was invited to their home for Christmas dinner in 2013.

The attorney said the diocese had no control over Kaup at that time.

The judge denied the motion to dismiss, but defense attorneys did win their push for the plaintiffs' identities to be revealed. The initial lawsuit only listed them as Mother Doe, Father Doe and Jane Doe.
