Defense lawyer: New witnesses found in case of man accused of murder in Charlotte protests

CHARLOTTE, N.C. — The man accused of shooting and killing a protester during the height of the 2016 Charlotte riots was back in front of a judge Thursday.

Rayquam Borum's attorney told the judge there's new evidence in the case.

It's been more than a year since Borum’s bond hearing.

Since then, he’s changed attorneys. Now, his attorneys hope to convince the judge he should have another chance to get out of jail.

Borum walked into the courtroom in shackles and stood silently next to his attorneys as they made their case for a new bond hearing.

They told the judge that since Borum's last bond hearing, they've identified some new witnesses in the case.

They said they hired a private investigator and an expert to review the surveillance video that shows the crowd of people in front of an uptown hotel during the protests and a brief flash that is apparently the gunshot that killed Justin Carr.

Most importantly, they said they have found some people who could challenge the state's case that Borum fired the fatal shot.

“Judge, there are new witnesses who testified to the cause of death of the victim in the case other than Mr. Borum,” Borum’s defense attorney said in court. “An alternate cause of death of this alleged victim, your honor.”

Borum's attorneys did not reveal who those new witnesses are, and in the end, Judge Robert Bell ruled that they didn't have enough new evidence to give Borum another bond hearing.

Borum will remain in jail until his case goes to trial, in December.
