Driver to be charged in death of crossing guard

MOORESVILLE, N.C. — State troopers will charge a 23-year-old CMS teacher in the death of a school crossing guard earlier this month.

The guard was killed while helping kids cross a busy Mooresville road during dismissal.

Troopers will serve 23-year-old Sarah McMinn with a misdemeanor charge for death by motor vehicle on Saturday. Her court date is in February. Eyewitness News has confirmed McMinn is an assistant teacher at Vance High School in Charlotte.

Crossing guard Frank Booth was helping students cross the road when he was killed two weeks ago. Neighbors who live near the school have told Eyewitness News that Booth always put up cones and wore a vest for safety during dismissal.

Troopers said McMinn wasn't speeding when she hit Booth and she wasn't impaired. She told troopers she didn't see Booth standing in the road near Mount Mourne Middle School.

Eyewitness News has been trying to find out why a school teacher wouldn't have known to be on the lookout for a crossing guard.

Seconds after a reporter knocked on McMinn's door at her Mooresville address, a car pulled up to the driveway and several adults got out and ran inside.

Several family members said "no comment" and "you wasted a trip to come up here."

Eyewitness News stopped by Booth's home in Mooresville to try to talk to family members and get a photo, but no one was home.
