Prosecutors: Woman's murder-for-hire plot not her first attempt

CHARLOTTE, N.C. — A Mecklenburg County school nurse supervisor accused of trying to hire someone to kill her ex-husband tried to do it once before, according to new court documents filed by the prosecution.

A grand jury indicted Fathia-Anna Davis in March on charges of racketeering murder and solicitation to commit a crime of violence.

A motion filed by prosecutors Friday claims that Davis also attempted to hire a hit man to kill her then-husband two years ago “but the hit man wanted to have sex with her and the deal was broken.”

The motion also claims Davis tried to poison her husband in October 2009. Prosecutors said a neighbor called 911 after seeing the family's dogs running loose in the neighborhood.
The husband answered the door when officers knocked and was "slurring his speech and stumbling" even though officers found no evidence he had been drinking, investigators said.

After the incident her husband was admitted to the hospital and tested positive for benzodiazepines, also known as tranquilizers, prosecutors said.

The former babysitter for the family discussed the 2009 attempted poisoning with investigators and said "she expected her husband to be dead upon her return… that she drugged his food and thought she timed it right with the time he would be driving," according to the court documents.

Davis' attorney, John Snyder, told Eyewitness News the claims of past attempts on her ex-husband's life are "without merit."
"If these things are true, obviously [law enforcement] would take them seriously and would have done something about them," Snyder said.

Snyder also said the babysitter who provided information to investigators was fired by Davis after not handling the care of their daughter very well.

Eyewitness News asked Charlotte-Mecklenburg Police Department Monday for a copy of the incident report but a representative for the department said they weren't able to locate one.
Davis was first arrested after a criminal complaint filed in February alleged she approached an unidentified man to find someone to kill her ex-husband. That man then told police, who began an undercover operation.

Davis agreed to pay undercover detectives $4,000 to shoot her ex-husband in the head, according to the affidavit.

Davis has worked for the county for nearly two years and has been the nurse supervisor for school health for the past three months, Mecklenburg County officials said.

Davis' duties include collaborating with Charlotte-Mecklenburg Schools staff and administrators, supervising the nursing staff and maintaining a healthy and safe working environment, according to the county.

She has been suspended without pay pending the outcome of the charges.
