What is the difference between HB142 and HB2?

North Carolina Gov. Roy Cooper signed a bill into law that repeals the controversial transgender bathroom law, House Bill 2.

But many have asked what does the new law mean for people in North Carolina?

House Bill 142 repealed HB2, which required transgender people to use restrooms in schools and government buildings corresponding to the sex on their birth certificate.

HB 142 resets the bathroom policies that were in place before Charlotte City Council passed the city’s nondiscrimination ordinance, which means a transgender person can use the bathroom of the gender with which they identify.

But the new law restricts cities from creating a nondiscrimination ordinance until December 2020. For example, Charlotte can’t create an ordinance that would provide a transgender person any protection. A transgender person can use the bathroom they identify with, but if there are any repercussions to their decision, that person won’t be protected. The General Assembly is the only one that would be able to create a nondiscrimination ordinance.

The new law also can’t force private businesses to follow bathroom rules.

Groups, like the American Civil Liberties Union and Equality NC, oppose the new law because it doesn’t provide protections for the lesbian, gay, bisexual and transgender community. They said they want equal rights.
