A Stanly County man was in jail Tuesday after officers said he committed two crimes in 24 hours.
Joseph Davis, 50, was charged with DWI and hours later police said he sexually assaulted a woman.
The Highway Patrol said he was taken into custody last week after he crashed his car on Big Lick Road in Stanly County. Troopers said they charged him with DWI and brought him to the Stanly County Jail.
However the jail refused to admit him, because he had injuries to his face and needed medical treatment.
Troopers took him to the hospital for treatment and brought him back to jail. According to jail records, Davis was never processed into the jail, but allowed to be released into the custody of a relative.
Oakboro Police said hours after he was let go, Davis sexually and physically assaulted a woman at his home in Oakboro and held her there. He was later charged, arrested, and was still in jail Tuesday night.
Police couldn't tell Eyewitness News the relationship between Davis and the victim.
We also asked the sheriff if it's standards protocol for someone charged with DWI to be released without being processed. He said the magistrate's office has the authority to do that. However, the magistrate's office wouldn't answer our questions about the case Tuesday.
