Attorneys want lawsuit in officer-involved shooting to go to federal court

CHARLOTTE, N.C. — The city of Charlotte wants a lawsuit filed by the family of a man killed by a Charlotte-Mecklenburg Police Department officer moved out of Mecklenburg County.

Attorneys filed a notice asking the civil suit filed by Jonathan Ferrell's family be handled in federal court.

The lawsuit accuses officer Randall Kerrick, CMPD Chief Rodney Monroe, the city and the county of gross negligence in Ferrell's death.

Ferrell was unarmed when he was shot by Kerrick in October. Kerrick has said he was afraid for his life.

Last week, a second grand jury agreed to indict Kerrick on voluntary manslaughter charges. A trial date has not been set.
