Colleton County Sheriff R.A. Strickland said a deputy told Raymond Allen he was breaking the law Tuesday as he walked down the sidewalk in Cottageville. In South Carolina, guns have to be concealed in public.
Strickland says Allen told the deputy federal law overrides state law and he was exercising his Second Amendment right to bear arms.
The sheriff in a statement praised his deputy for watching out for the safety of everyone.
Allen is charged with unlawful carrying of a handgun. It wasn't known if he had a lawyer.
