CMPD Sergeants Sue City For Overtime Pay

CHARLOTTE, N.C.,None — More than 30 Charlotte-Mecklenburg Police sergeants have filed a lawsuit against the city, claiming the department owes them thousands of dollars in back pay.

They didn't think the suit would be necessary, but filed it as a last resort after, they said, the city didn't live up to its end of a bargain.

Sgt. Mike Hervey thought he had one the legal battle last May.

He was one of a handful of CMPD sergeants who filed a complaint with the Department of Labor asking for overtime pay from the city.

At that time, the city agreed to pay about $180,000 in overtime.

However, the suit filed today claims the city has "failed to pay to plaintiffs all unpaid overtime," and asks for back pay plus penalties for violating labor laws.

The city attorney said he had not yet seen the lawsuit, but may have a response on Monday.
