Cooper, Stein file lawsuit to overturn part of controversial Senate Bill 382

RALEIGH — North Carolina Gov. Roy Cooper and Attorney General Josh Stein are suing the leaders of the state’s legislature.

This comes after the Senate overrode the governor’s veto of Senate Bill 382.

That bill set aside $227 million for Helene relief but also included a provision to strip power from incoming Democratic state leaders.

And part of that was the governor’s ability to pick the commander of the North Carolina Highway Patrol.

The new law makes the highway patrol an independent agency and allows the legislature to reject Stein’s choice for the position.

The lawsuit said it is the governor’s responsibility to help keep people safe and that the constitution gives the governor control over public safety.
