Defense seeks to quash evidence in Tucker case

CHARLOTTE — A federal judge heard testimony Monday as the defense seeks to suppress certain evidence in the drug case of a retired SBI agent's son.

Ryan Tucker used his father, Frederick Tucker, to bring cross-country drugs into Charlotte, according to court documents.

However, defense attorneys are trying to stop evidence from an April 2014 traffic stop from being presented at trial.

A CMPD officer who conducted the traffic stop said he stopped the vehicle Tucker and his then-girlfriend were in. During the stop, the officer said he observed drug paraphernalia inside of the car and said the woman exhibited signs of recent heroin use.

Officers then removed both from the car.

An ensuing investigation found nearly a quarter of a million dollars in cash in the back of the truck.

The defense argued Monday that the officers didn't have probable cause and therefore the search of the truck was unlawful.

Magistrate Judge David Cayer did not make a ruling Monday but said he would do so in a memorandum at a later date.
