Supreme Court expected to make decision on Prop. 8

CHARLOTTE, N.C. — The U.S. Supreme Court will resume sessions on Tuesday and begin by discussing controversial landmark cases that could affect North Carolina's amendment one.

The justices are expected to make decisions on whether same-sex partners of federal employees qualify for benefits and if California's Proposition 8, which bans gay marriage, is legal.

Many people are paying close attention to the Proposition 8 case to see if it could also strike down North Carolina's amendment one, which also banned gay marriage.

A UNC Charlotte professor says that's not likely to happen.

"They will probably strike down Prop 8, but do it in a way that's narrow and only applies to California," said John Szmer.

Szmer said the only way the court's decision would impact any state besides California is if justices made a broad ruling saying all bans on same-sex marriage are unconstitutional.
