Suspect released from hospital, charged after shooting involving CMPD

CHARLOTTE — A 39-year-old man is facing multiple charges after a September shooting involving police officers in northeast Charlotte.

The Charlotte-Mecklenburg Police Department said they responded around 9:15 a.m. Sept. 1 to a report of a violation of a domestic violence protection order in the 4200 block of Autumn Frost Trail.

The caller told dispatchers they believed the suspect was headed to their home and had a firearm. The caller went to a nearby business to wait for officers.

When officers arrived, they encountered the suspect outside. According to CMPD, preliminary information indicates the man pulled out a firearm and pointed it toward officers.

Police said officers gave multiple commands for him to drop the weapon before an exchange of gunfire occurred. Officers struck the suspect.

The suspect, identified as 39-year-old Darnell K. Simms, was released from the hospital on Oct. 9 and taken to the Law Enforcement Center for an interview with homicide detectives. He was later transferred to the Mecklenburg County Sheriff’s Office.

Simms faces four counts of attempted murder, five counts of misdemeanor assault with a deadly weapon, three counts of shooting into an occupied dwelling, one count of possession of a firearm by a felon, five counts of damage to property, and one count of violating a domestic violence protection order.
