A grand jury has indicted an 18-year-old alleged gunman on a charge of domestic terrorism motived by hate and 10 counts of first-degree murder.
Payton Gendron is now scheduled to be arraigned Thursday in Erie County Court in New York.
Gendron is accused of shooting and killing 10 Black people at a Buffalo supermarket on May 14. He has been in custody since the shooting.

Gendron had been originally charged with first-degree murder and had pleaded not guilty, The Associated Press reported.
WKBW reported that the indictment included:
- Domestic act of terrorism motivated by hate in the first degree
- 10 counts of murder in the first degree
- 10 counts of murder in the second degree, as a hate crime
- Three counts of attempted murder in the second degree, as a hate crime
- Criminal possession of a weapon in the second degree

Investigators said that Gendron drove three hours from his home in Conklin, New York, near the Pennsylvania border, with the intent of killing as many Black people as possible, according to the AP. He had been told to leave the store the day before the shooting after apparently bothering customers, ABC News reported.
