CHARLOTTE, N.C. — Police have determined a homicide in September was “justified” after they found a man dead and another shot in northwest Charlotte.

The shooting happened Sept. 6 at around 3:30 a.m. on South Crigler Street, which is near Rozzelles Ferry Road and Interstate 85.

Officers have not said what led to the incident, but authorities are not charging anyone for the homicide.

Officers said they were called to respond to a welfare check in the area. When they got there, they found Oldin Jacinto Diaz Lainez, 45, dead. Authorities have not said how he died.

Police also found another man with a gunshot wound. He was taken to the hospital, but he is expected to be OK.
