Ferrell's family attorney wants answers in deadly shooting

CHARLOTTE, N.C. — Tuesday marked 31 days since Charlotte-Mecklenburg Police Officer Randall Kerrick shot Jonathan Ferrell a dozen times in northeast Charlotte.

Ferrell's family attorney, Chris Chestnut, told Channel 9 he is no closer to getting answers.

Chestnut claims CMPD promised to provide copies of the dash camera video from the night of the shooting.

"It shows the timing of the shots, the sequence of the shots, the pauses in between individual shots that demonstrate Officer Kerrick had time to pause, contemplate, consider and reconsider whether he was going to continue to pull the trigger," said Chestnut.

Chestnut also requested communication between the 911 dispatcher and police plus Kerrick's personnel file; however, he claims CMPD refuses to hand it over and is incorrectly interpreting that the information can't be released under North Carolina law.

'It's their discretion," said Chestnut. "They could have given it to us as they promised but they haven't. Obviously, they are trying to hide something and it's the truth. They're trying to hide the truth. Video is the truest depiction, the truest illustration of what happened that night."

Chestnut is planning multiple network TV interviews this week in hopes the attention brings answers.

"Now, we're becoming concerned that perhaps law enforcement thinks we're going to go away," he said.

CMPD told Channel 9 they provided the redacted 911 call and said the rest of the requests are not public record.

Those requests cannot be fulfilled when there is an open and pending criminal case and Chestnut is not a part of the criminal case, according to CMPD.

The matter is now being reviewed by the N.C. State Bureau of Investigation and the attorney general's office, according to the CMPD.

The attorney general’s office told Channel 9 that this is an ongoing investigation and Chestnut's requests are not public record.

Chestnut said the Ferrell family also plans to file a civil lawsuit against the city, but it's not clear when.
