CHARLOTTE, N.C. — Police are investigating after a Johnson C. Smith University student reported being sexually assaulted by a fellow student.
Jordan Westbrook, 20, was charged with attempted second degree forcible rape and second-degree forcible sex offense.
School leaders said Westbrook knew the person he was accused of sexually assaulting.
The alleged attack happened at Mosaic Village, which is school housing.
A female Johnson C. Smith University student said Westbrook entered her room in Mosaic Village on Nov. 5 by using her code to get in, according to the police report.
The female student told police that once inside, Westbrook took off his clothes and got in bed with her.
The female student told police she repeatedly told Westbrook no and to stop. She said Westbrook used one hand to sexually assault her and placed the other hand in her mouth.
The female student called Westbrook's mother during the incident but Westbrook hung up the call, according to the police report.
The female student told police she was able to get Westbrook to stop by kicking him in the groin area.
The female student reported the incident to police five days after it happened. She decided to press charges this week.
Channel 9 asked school leaders why no emergency alert was sent to students.
School leaders tell Channel 9 no alert was sent because the two people involved knew each other. A spokesperson for Johnson C. Smith University says Westbrook was disciplined by the school.
School leaders released this statement on the incident:
"Johnson C. Smith University seeks to create and maintain a safe environment in which all members of the University community can learn and work free from fear of sexual assault, sexual harassment and discrimination; relationship violence and stalking. Any behavior that is determined to constitute these offenses is treated seriously and is subject to appropriate disciplinary actions and/or criminal sanctions.
The victim reported the crime to Campus Police around the time of the incident but chose not to prosecute. Instead, the allegations were investigated by the Title IX Coordinator and deputy coordinator and referred to the University's judicial process for review, where it was treated as a serious matter and appropriate disciplinary sanctions were levied. The victim then decided to file criminal charges, as is her right.
The University's investigation and disciplinary action are independent of any action taken in the criminal and civil courts. Individual student sanctions are imposed in accordance with the University's Standard of Conduct found in the Student Handbook. Possible sanctions imposed range from a warning up to and including expulsion, depending on the severity of the incident, and taking into account any previous disciplinary infractions."
Westbrook is in Mecklenburg County Jail. His bail is set at $200,000.
