Driver charged with DWI after pedestrian killed in hit-and-run crash

CHARLOTTE, N.C. — A man is dead after being hit by a car around 3 a.m. Friday on the Brookshire Freeway, near Interstate 85.

Police said Nefertiti Carial Foust, 53, was pronounced dead at the scene.

Authorities said the driver, identified as Donivan Winters, did not stop after hitting the man, but police were able to find him and take him into custody a short time later.

Detectives said Winters was driving a 2006 Ford F-150 northwest on the Brookshire when he hit the man near the median.

Channel 9 was the only station there when police found Winters. Officers made him perform a field sobriety test and could be seen placing Winters in handcuffs while he resisted.

Police said speed was not a factor but alcohol impairment was. Winters was charged with DWI, felony death by motor vehicle and felony hit-and-run.

The Brookshire was closed in both directions while police investigated the crash but all lanes were reopened around 5:30 a.m.

While officers were investigating the deadly collision, Channel 9 watched as another car drove through the police barricade, nearly hitting the victim's body in the roadway.

Officers were able to get the driver to stop and he was charged with DWI.

Moments later, a passenger in that car got into an argument with police and was charged with having an open container.
