MOORESVILLE, N.C. — Two days after a head-on collision sent a woman and three children to the hospital, the Statesville Record and Landmark reported the youngest child in the car, a 4-year-old girl, has died.
The driver, Danielle Toupin, is still at the hospital, and so are the other two children in the car. The woman's ex-fiance told Eyewitness News Toupin is heartbroken about what has happened.
Tim Maudlin was engaged to Toupin for several years. They have an 8-year-old daughter together.
Troopers said the three young children in Toupin's car were not using booster seats when the accident happened on Shinnville Road in Mooresville on Tuesday.
Maudlin said when his ex-fiance drives their daughter she always uses a booster seat. He said he's stunned to hear the children weren't properly restrained at the time of the wreck.
"It's shocking, yes," he said. "I mean, what can you say?"
Troopers said Toupin crossed the center line and hit a pickup truck.
"She's been through a lot. She's got a lot on her shoulders," Maudlin said.
Maudlin visited his ex-fiance at the hospital and said she will make a full recovery. He said she's emotional about the accident.
"She knows the extent of what's going on, what happened. She's heartbroken. She really is," he said.
Because of their ages, all three children were required by law to be using a car seat or booster seat. Troopers said charges are pending, but they haven't been filed.
"Apparently she has a medical condition," Maudlin said. "And at the time, she went through a seizure, and that's what caused the accident."
He told Eyewitness News she's suffering enough and shouldn't face criminal charges.
Eyewitness News called the Highway Patrol several times Thursday night, but there's no word yet on if they filed charges.
