ALLEGHANY COUNTY, N.C. — Billy Packer and his Olde Beau Golf & Country Club partners have agreed to a mediator in a breach-of-contract lawsuit filed by a Davidson company as the judge in the case considers Packer’s motion to dismiss.
Meanwhile, Business Court Judge Gregory McGuire has denied a motion by Packer to cancel a notice filed in Alleghany County that there is a court case pending that could challenge the title to some of the Olde Beau property. McGuire found that the allegations in the suit could, if proved, support the notice. He ruled Packer’s motion to cancel the notice is premature.
In the suit, Davidson-based Morris International Inc. accuses Packer, two of his companies and several partners in Olde Beau of breach of contract and unfair and deceptive trade practices, among other counts. The company said Packer, a sportscaster-turned-land-investor, and the others welshed on a joint-venture agreement to build a recreational-vehicle resort at the golf club in Alleghany County.
McGuire has scheduled a hearing for July 9 in the Business Court’s Raleigh location for arguments on a motion by Packer to dismiss the case. Packer and his co-defendants contend that the agreement between them and Morris “was not a joint venture and there was no fiduciary relationship between the parties.” They also contend the suit fails to claim sufficient facts to support the civil counts against the defendants.
