CHARLOTTE, N.C. — The driver in a fatal crash earlier this month in west Charlotte was charged Thursday with second-degree murder, DWI and DWI felony serious injury, CMPD said.
The collision happened on Sept. 5 just before 5 p.m. on West Boulevard near Remount Road.
Police told Channel 9 a driver was trying to turn when a Lexus crossed a double yellow line to pass him. Officers said the Lexus was going at least 90 mph and hit the car before sliding into the pickup truck.
The passenger in the Lexus, Antonio Bennett, died.
The two drivers went to the hospital, and police initially planned to charge the driver of the Lexus -- Shomari Pinkney-- with involuntary manslaughter, reckless driving and driving with revoked license.
Investigators determined Pinkney was impaired at the time of the crash.
Pinkney was later released from the hospital, charged and taken to the Mecklenburg County Jail.
