A group of parents is taking legal action Tuesday against Facebook saying the social media network is using children’s images in ads without parental consent.
Last month, Facebook settled a lawsuit about the ads.
Facebook agreed to new rules for how children’s images would be used.
However, parents who filed an appeal Tuesday say the lawsuit still leaves a giant loophole, allowing the kids themselves to give permission.
“I found my daughter’s face on the Facebook pages of a bunch of clothing companies. It just infuriated me,” said mother Annie Leonard.
“They may be tagged by association with those things on the Internet for years to come,” said attorney Scott Michelman.
The parents are demanding Facebook not use minors in ads without parental permission.
A Facebook spokesperson said, "We believe these claims are without merit. The court-approved settlement provides substantial benefits to all class members, including minors, through enhanced notice and consent provisions and innovative new tools related to advertising."
